ARTICLE VI    SENIORITY

Section 6.1

  1. The seniority of each employee consists of his/her relative tenure with respect to other employees in his/her Job Classification within his/her respective Division of the Maintenance Shop. An employee's first one hundred and twenty (120) days of employment by U.R.E.O.O. shall be a probationary period.

  2. It is the intent of this Article that job security shall be based on seniority with U.R.E.O.O. In the event of a reduction in force, the probationary employees shall be laid-off first. In the event of a further reduction in force in any Job Classification within any Division, the employees with the greatest seniority shall be retained for available jobs within the Job Classification and Division.

  3. An employee promoted to a higher Job Classification, or to the Supervisory Staff shall continue to retain his/her seniority in his/her previous Job Classification for a period of six (6) months after the effective date of such promotion.

  4. No employee shall be entitled to benefits of seniority until s/he has completed one (1) year of service at U.R.E.O.O. Maintenance Shop.

  5. Seniority shall continue to accumulate during:

    1. Absences caused by illness or injury incurred in the course of employment equal in length to the employee's seniority standing immediately prior to the occurrence of illness or injury, but not to exceed a maximum of two (2) years (at which time seniority and the employment relationship terminate).

    2. Absence for military service to the extent provided in the Universal Military Training and Service Act, as amended, after which seniority and the employment relationship terminate.

  6. In addition to the reasons set forth in E above and G below the employment relationship shall terminate and accumulated seniority shall be lost when: an employee resigns, is discharged, terminated for lack of work, or fails to report for work within three (3) days after s/he had been requested to return to the same or a comparable job following a temporary layoff, provided, however that accumulated seniority shall be retained by an employee, if rehired within thirty (30) days following resignation or discharge. U.R.E.O.O. accepts no responsibility to recall a laid-off employee after one (l) bona fide offer of a comparable job within the bargaining unit.

  7. The employment relationship and seniority shall terminate when an employee ceases to be in active employment for a period equal to the length of his/her accumulated seniority immediately prior to the last day of work, to a maximum of one (l) year. During such time s/he shall continue to retain seniority accumulated to the date of layoff, and shall, subject to the provisions of this Agreement, be recalled in order of seniority, as defined in A and B above, before new employees are hired.

  8. Any employee selected as an officer or delegate of the Union shall be allowed half or full days off, except during emergency work conditions, upon seven (7) days prior written notice to U.R.E.O.O. for the performance of Union duties relating to the U.R.E.O.O. unit without loss of seniority rights, but without pay.

Section 6.2

Where practicable, an employee shall receive not less than five (5) working days advance notice of layoff.

Section 6.3

Whenever temporary workers regularly employed twenty (20) hours or more per week are accepted as regular employees, their seniority shall commence with the last date of hiring as temporary workers provided there has been no break in service exceeding seven (7) calendar days.

Section 6.4.1

The University shall bring to the attention of its employees new positions and vacancies by posting these positions weekly – by paper and electronic format -- for a period of at least seven (7) calendar days except when emergency conditions require such vacancies to be filled within a shorter period of time. Such notices shall identify the vacant job by a special I.D. number, the posting date and the date the job will be taken off posting, the name of the department, location of the job, the title, working hours and the rate of pay.

Section 6.4.2

Whenever a new position is created that is known to be of more than one-hundred twenty (120) calendar days duration, it shall be posted as a regular position. If a temporary position continues to exist for more than one-hundred twenty (120) calendar days, it shall be posted as a regular position, except, when the position provides coverage for a disabled employee on extended sick leave, short-term disability, long-term disability or workers compensation. In that case, the temporary position shall be posted once it is determined that the disabled employee will be unable to return to work.

Section 6.4.3

Employee resumes should be submitted during the posting period in a format provided by the University. Any additional relevant records, recommendations and transcripts may be required or furnished at the time of interview.

Section 6.5

U.R.E.O.O. will compile and post a list for each Division and Job Classification showing the seniority therein, effective each January l.
